YorDigital Presence: Data Processing Terms

1. When these terms apply

These terms form part of the YorDigital Presence terms of service. They apply when you give us personal data about other people so that we can provide the service, for example people shown in photos or video you send us, or people named in your emails, reviews or posts. For that data, you are the controller and YorDigital Services Limited is your processor. Our privacy policy covers the data we hold about you as our customer.

We are the controller, not your processor, for the records we keep for our own legal and accounting purposes: payment and accounting records, and the minimal record of our dealings with you described in the terms of service and privacy policy, which may include the date and fingerprint of a file you sent us. We keep those only for those purposes.

2. What we will do

  • Process that data only on your documented instructions, which are the terms of service, your settings and your instructions to us, unless the law requires otherwise. If it does, we will tell you first unless the law forbids it.
  • Make sure anyone who handles it is bound to keep it confidential.
  • Take appropriate technical and organisational measures to keep it secure.
  • Use other processors only with your general authorisation, which you give by accepting these terms, and only under written terms that give the same protection. We will tell you of any intended change, and if you object you may cancel.
  • Help you, as far as reasonably possible, to respond to requests from people exercising their data rights and to meet your security, breach and impact-assessment obligations.
  • Tell you without undue delay if we become aware of a personal data breach affecting your data.
  • Delete the data when the service ends, on the timetable in the terms of service, unless the law requires us to keep it. This does not apply to the records we keep as controller described in section 1.
  • Make available the information needed to show we meet these terms, and allow for and contribute to audits on reasonable notice.

3. What you will do

You confirm that you have a lawful basis for giving us the data, and any permissions you need from the people involved.

In particular, you confirm that anyone recognisable in photos or video you send us has agreed to it being used in your posts, and that for anyone under 18 a parent or guardian has agreed. You will not send us special category data (such as health information) about other people unless it is needed for a post you have asked for and you have their explicit consent. If someone asks for their data to be removed, tell us and we will remove it from the service promptly; if they ask us directly, we will remove the photo or content and tell you.

4. Transfers outside the UK

We transfer data outside the UK only with safeguards approved under UK law.

5. Everything else

These terms were last changed on 14 October 2026; for customers who signed up before that date, the changes take effect on 14 November 2026. Liability is as set out in the terms of service. If these terms conflict with the terms of service on data protection, these terms apply.
